What are the general terms and conditions?
The general terms and conditions are part of the (purchase) agreement. For example, you can describe in it:

To pay Delivery time transportation guarantee dispute The general terms and conditions describe the standard conditions for all your transactions. The general terms and conditions have nothing to do with the details of your product or service, such as price or color.

Are the general terms and conditions mandatory
You do not need to make general terms and conditions. Legal requirements always apply to purchase agreements between you and your customers. In the Netherlands, a number of industry organizations, usually together with consumer organizations, have jointly formulated general terms and conditions. Please contact your industry organization (MKB-Nederland in Dutch) to find out if they have an organization for you. Some sectoral organizations do enforce the use of general terms and conditions, for example in childcare.

If you do use the general conditions, they apply to you and your customers. You can submit your general terms and conditions to the Chamber of Commerce (KVK) or the court. This is also not mandatory.

Unreasonable conditions
You cannot have unreasonable conditions (in Dutch). The law states what is unreasonable and what conditions may be unreasonable (in Dutch).

Disclosure obligations
If you want to apply the general terms and conditions, you must inform your customers of your general terms and conditions before signing the contract. Use clear language to set your general terms and conditions and make sure your customers know what they are.

Modify the general terms and conditions
You can change the general terms and conditions when you do business with customers, but not on a whim. You must inform your customers of these changes in easy-to-understand language.

If you provide ongoing products or services, such as subscriptions, you cannot simply change the general terms and conditions. You must abide by the following rules: It must be clear at the time of purchase that you can change the conditions at any time. You must notify your customers of changes to your general terms and conditions. A short note is not enough. These changes must be reasonable. For example, your customers should be able to terminate the agreement (such as their subscription). And you cannot change the subscription price within 3 months.

Cancel general terms and conditions
Your customer has the right to cancel the general terms and conditions if one of the following situations occurs:

You failed to comply with the rules of the general terms and conditions: for example, your terms are unreasonable; You suddenly changed your terms and did not notify your customers clearly in time. Revocation will invalidate your general terms and conditions.
